General Terms and Conditions of Sale

1/ DESIGNATION OF THE PARTIES TO THE CONTRACT

CANOE-FRANCE.COM is owned by GIE Rivières de France.
Registered office: 190, chemin de la Tuilière – 26340 SAILLANS, France.
Registered in Romans under number 385 198 676.
Representative: Mr. MARFAING

The partner lessor refers to the service provider supplying the equipment and service designated in the contract.

The customer (canoe/kayak renter) refers to the adult making the reservation.
IMPORTANT: The customer cannot be a minor.
The customer agrees, both for themselves and for anyone for whom they have booked a product (rental, activity), to accept and comply with these general terms and conditions of sale.
The customer agrees to inform anyone for whom they have made a reservation of the content and commitments outlined in these general and specific terms and conditions of sale.

Submitting the booking form constitutes a contract between the customer and the partner rental company. Following this booking, a confirmation email will be sent to the customer.

2/ SPECIAL CONDITIONS FOR CANOE-KAYAK RENTAL

2-1/ Preliminary Information

A/ Age of the customer and users of the equipment

Canoeing and kayak rentals are regulated by French law, which may be reinforced by prefectural or local decrees.
Rental by any minor unaccompanied by an adult is prohibited.
Special cases: On certain rivers or in specific geographical areas, local regulations may restrict rentals, for example, based on age (prefectural or municipal decrees). Check with the rental partner.
The customer remains responsible for the individuals for whom they have rented equipment.

B/ The skills required for navigation

In the event of non-compliance with the following clauses, no deposit refund will be made and the sums paid will be definitively acquired by CANOE-FRANCE.COM.

Navigation is prohibited for people who cannot swim at least 25 meters and submerge themselves.

Adults or legal guardians of minors attest that the minors are able to swim at least 25 meters and submerge themselves.
The legal guardians of minors are their father, mother, or legal guardians. When a minor is not accompanied by one of these legal guardians, any customer wishing to paddle with minors must be able to present (at the time of equipment rental) a certificate from the legal guardian attesting to their abilities.
CANOE-FRANCE.COM advises against canoeing and kayaking for pregnant women. On the scheduled day of the trip, the partner rental company may refuse them permission to depart on the river.
The customer attests to having the necessary physical abilities to complete the chosen route.
By signing the rental agreement, the customer declares and attests that the people accompanying them and for whom they have rented equipment meet the required abilities for paddling listed above and that they have verified these abilities with them.

C/ Civil liability insurance

CANOE-FRANCE.COM carries professional liability insurance.
CANOE-FRANCE.COM's partner rental company is insured by a policy covering its civil liability (see posted information).
By signing the contract, the customer declares and attests that they and any persons they authorize to use the rented equipment are covered by a civil liability insurance policy.

D/ Accessories

CANOE-FRANCE.COM and the partner rental company are not responsible for vehicles parked in the rental car park.

2-2/ Purpose of the contract

A/ The equipment

CANOE-FRANCE.COM's partner rental company provides the customer with the following equipment, as specified in the contract (type and quantity):
– Boats: canoe or kayak
– Personal protective equipment: buoyancy aid known as a "life jacket" (wearing which is mandatory).
– Equipment necessary for canoeing and kayaking: paddles and waterproof containers (drums) for carrying the customer's personal belongings during the trip.
All equipment provided to the customer is in perfect working order and well-maintained, in accordance with its intended use and regulations.
CANOE-FRANCE.COM's partner rental company informs the customer and provides instructions for using the rented equipment and keeps up-to-date records of equipment monitoring and inspection.

B/ Conditions of use of rented equipment

The rental agreement transfers custody of all rented equipment to the customer for the entire rental period.
The rental begins when the customer takes possession of the equipment and ends when the customer returns it to the rental company. A joint inventory will be conducted upon return by both parties, namely the customer and the rental company.
CANOE-FRANCE.COM and its partner rental company cannot be held liable for damages caused to the customer, to persons authorized by the customer to use the rented equipment, to third parties, or to the customer's property and that of said persons, due to improper use of the rented equipment by the customer or said persons.
The watertightness of the containers cannot be guaranteed by the rental company, as this depends on the user closing them.

C/ Customer obligations relating to rented equipment

Wearing a personal flotation device (also called a life jacket) is mandatory throughout the entire descent. It must be fastened and adjusted close to the body at all times while the client is canoeing or kayaking.
CANOE-FRANCE.COM and its partner rental company are not responsible for the use of the rented equipment, particularly navigation, nor for the closing, securing, and monitoring of bags, dry bags, or the personal belongings of the client and those paddling with them.
The client remains fully responsible for all property carried by themselves and those for whom they have rented equipment. CANOE-FRANCE.COM and its partner rental company cannot be held liable for any loss, theft, or damage to the client's or those paddling with them that occurs during the descent.
The rented equipment is for the client's sole use and may not be sublet.

2-3/ Courses offered for rent

A/ Information on routes and navigation conditions

CANOE-FRANCE.COM offers a range of canoe trips. For each trip, it indicates the distance, the average paddling time (excluding any stops), the starting and ending points, applicable regulations (navigation, traffic, environment), and the difficulty level.
In the event of adverse weather or hydrological conditions, the rental company may refuse the rental, subject only to the reimbursement of any deposits paid.

B/ Choice of route

The customer is free to choose the route that suits them and the people they authorize to use the rented equipment. The route chosen by the customer is specified in the rental agreement.
The customer confirms that they and the people they authorize to use the rented equipment have informed themselves of the regulations, difficulties, and dangers of the route they have chosen to follow.

2-4/ The client's obligations relating to the execution of the descent

The CANOE-FRANCE.COM partner rental company informs the customer of the regulations and signs applicable to the nautical routes, the navigation classes, the land routes for exiting the route, the hydrological and meteorological data, the conditions for crossing structures established on the watercourse when such structures exist and the emergency contact numbers (Displays).

A/ General French regulations concerning canoe and kayak navigation

In general, in France, navigation on a waterway is prohibited when:
– The air temperature is equal to or below 0°C
– During thunderstorms or weather alerts
– When the river rises and reaches its alert level.
Specific regulations may apply to certain rivers or well-defined geographical areas (prefectural or local).

Note: Wearing closed-toe shoes is mandatory (see prefectural decree).

B/ Loss/Abandonment/Behavior

Abandoning any equipment on the route is prohibited. Any abandonment will be charged by the partner rental company at the price of the rented equipment, plus the cost of repatriating the boat and people; search fees will be charged and must be paid immediately.

Loss of equipment: failure to return the rented equipment, for whatever reason, will result in the customer being invoiced for the full value of the equipment in new condition at the public selling price, in addition to the rental cost, payment will be made without delay.

The client agrees not to leave any litter on the riverbanks and to dispose of it in a bin.
Damage to any public or private property on the riverbanks is prohibited, under penalty of contractual, civil, or criminal liability.
The client agrees to be courteous and respectful of residents and other users of the waterway.
The client undertakes the descent at their own risk and acknowledges having been informed of the specific conditions for completing this route.

3/ MODIFICATION

The reservation is valid for the reserved period and may be modified by the client.
For any reason (change of route, shuttle schedule, number of people, date, boat, etc.), the requested modification must be sent to the rental company by email no later than 48 hours before the date indicated on the rental agreement and will only be effective subject to availability. The modification will be systematically confirmed by email to the client; only receipt of this email will release them from their previous reservation. If this modification results in a price increase, the difference must be paid at the rental company's reception before departure. If the modification results in a price decrease, the amount may be credited towards all our services during the current season.

4/ CANCELLATION/WITHDRAWAL

By the customer subject to the following conditions:

Individual customers (non-professionals) may withdraw from and cancel their reservation. In the event of cancellation, the customer will have the option of using the payment made to book for another date within the current season.

CANOE-FRANCE.COM reserves the right to reimburse the consumer for all sums paid, within a maximum of 30 days following the date of reservation.

Special cases giving rise to full and individual reimbursement:
Force majeure: death, hospitalization, serious illness (upon presentation of supporting documentation). Please note that for groups, only the individuals concerned will be reimbursed.

By the service provider:

If, for safety reasons (flooding, weather conditions, etc.), the service provider is forced to cancel the service, they will inform the client as soon as possible and provide a full refund of all payments made. In this case, they cannot be held responsible for the non-performance of the service and cannot be ordered to refund the consumer double the deposit paid.

5/ RATES AND PAYMENT FOR SERVICES

The prices shown on the website www.canoe-france.com are inclusive of all taxes in euros, taking into account the VAT applicable on the day of the order.

The price includes, for each route offered by CANOE-FRANCE.COM, the necessary equipment for navigation and transportation (if required).
Accessories such as wetsuits are charged separately by the partner rental company (unless they spontaneously offer to lend this equipment free of charge due to weather conditions), as well as other services that may be requested by the client (meals, instruction by a certified guide, etc.).

The customer agrees to pay the balance of all services by credit card at the time of booking on the CANOE-FRANCE.COM website, via the secure Stripe platform.

6/ APPOINTMENT TIMES AND DELAYS

A specific meeting time is provided for certain routes; adherence to this time is mandatory.
In the event of a significant delay, the partner rental company may, if possible, offer an alternative time or date. If no alternative solution can be offered, the rental will be canceled without the customer being entitled to a refund of the deposit paid to CANOE-FRANCE.COM.
Customers reserving equipment on the CANOE-FRANCE.COM website certify that they have read and understood the general and specific terms and conditions of sale stated above and agree to inform the participants in their group of all the details.

7/ PERSONAL DATA

In accordance with the French Data Protection Act of 6 January 1978, users have the right to access and rectify data concerning them.

8/ DISPUTE RESOLUTION

These online sales terms and conditions are governed by French law. In the event of a dispute, jurisdiction is granted to the court of Valence
