Terms of Sales

1/ DESIGNATION OF THE PARTIES OF THE CONTRACT

CANOE-FRANCE.COM is the property of GIE Rivières de France.

The rental partner designates the service provider providing the equipment and the service designated in the contract.

The customer (canoe kayak renter) designates the adult person who makes the reservation.
PLEASE NOTE: The customer cannot be a minor.
The customer undertakes for himself and for the people for whom he has reserved a product (rental, activity) to accept and respect these general conditions of sale.
The customer undertakes to inform the people for whom he has made a reservation of the content and commitments of these general and special conditions of sale.

Validation of the reservation form constitutes a contract between the customer and the rental partner. Following this reservation, a confirmation email will be sent to the customer.

2/ SPECIAL CONDITIONS FOR CANOE-KAYAK RENTAL

2-1/ Prior information

A/ Age of customer and equipment users

Navigation and rental of canoes and kayaks are regulated by French regulations. These regulations can be reinforced by prefectural or local decrees.
Rental by any minor not accompanied by an adult is prohibited.
Special case: On a certain river or in a specific geographical area, local regulations may restrict the possibility of rental, for example based on age (prefectural or municipal decrees).
Ask your partner rental company for more information. The customer remains responsible for the people for whom he has rented the equipment.

B/ The capabilities required for navigation

In the event of non-compliance with the following clauses, no refund of the deposit will be made and the sums paid will be definitively acquired by CANOE-FRANCE.COM.

Navigation is prohibited for people who cannot swim at least 25 meters and submerge themselves.

Adults or legal representatives for minors certify that they have the ability to swim at least 25 meters and submerge themselves.
The legal representatives of minors are their father, mother or guardians.
When the minor is not accompanied by one of these legal representatives, any customer who wishes to sail with minors must be able to present (at the time of picking up equipment) for the latter, a certificate from the legal representative, attesting to these abilities. CANOE-FRANCE.COM does not recommend canoeing or kayaking for pregnant women.
On the day planned for the descent, the rental partner may refuse to allow her to leave on the river. The customer certifies having the physical abilities necessary to complete the chosen route.
The customer declares and certifies by signing the rental contract that the people accompanying him and for whom he has rented equipment meet the abilities required for navigation listed above and that he has properly checked said required abilities with them.

C/ Civil liability insurance

CANOE-FRANCE.COM is insured in professional liability, guaranteeing its professional liability.
The rental partner of CANOE-FRANCE.COM is insured by a policy guaranteeing its civil liability (See display on site).
The customer declares and certifies by signing the contract that he and the people he authorizes to use the equipment he has rented are insured by a policy guaranteeing their civil liability.

D/ Accessories

CANOE-FRANCE.COM and the rental partner are not responsible for vehicles parked in the rental car park.

2-2/ Purpose of the contract

A/ The material

The rental partner of CANOE-FRANCE.COM makes available to the customer, according to what is specified in the contract (nature and quantity):
– Boats: canoe or kayak
– Individual protective equipment: buoyancy aid known as “ life jacket” (which must be worn).
– Equipment necessary for canoeing: paddles and waterproof containers (cans) to transport the client's personal belongings during the descent.
All equipment made available to the customer is in perfect working order and maintained, in accordance with its destination and regulations.
The rental partner of CANOE-FRANCE.COM informs and gives instructions for the use of the rented equipment and keeps the records of monitoring and control operations of the rented equipment up to date.

B/ Conditions of use of rental equipment

The rental contract transfers custody of all rented equipment to the customer for the entire duration of the rental.
The rental begins when the customer takes possession of the equipment and ends when the equipment is handed over by the customer to the rental company.
A contradictory inventory will be made during the return between the two parties, namely between the customer and the rental company. CANOE-FRANCE.COM and the rental partner cannot be held responsible for damage caused to the customer, to the people whom the latter has authorized to use the equipment rented by him, to third parties, to the customer's property and to that of said people, due to non-compliant use of the equipment rented by the customer or said persons.
The watertightness of the drums (watertight containers) cannot be guaranteed by the rental company because it is subject to closing by the user.

C/ Customer obligations relating to rented equipment

Wearing buoyancy aid(s) (also called life jacket) for the entire duration of the descent is mandatory; it must be closed and adjusted close to the body at all times, as long as the client practices canoeing and kayaking.
CANOE-FRANCE.COM and the rental partner are not responsible for the use of the rented equipment, in particular for navigation, nor for the closing, tying and monitoring of bags, waterproof containers, personal belongings. of the customer and those who sail with him.
The customer remains fully responsible for all goods taken by himself and the people for whom he has rented equipment.
CANOE-FRANCE.COM and the rental partner cannot be held responsible for loss, theft or breakage of any property belonging to the customer and the people sailing with them, occurring during the descent. The rented equipment is intended for the sole use of the customer without the possibility of subletting.

2-3/ The courses offered for rental

A/ Information on routes and navigation conditions

CANOE-FRANCE.COM offers a range of descents.
It indicates for each of them the mileage, the average duration of navigation (excluding possible stopping times), the place of start and end of the route, the applicable regulations (navigation, traffic, environment), the difficulties of these descents. In the event of unfavorable weather or hydrological conditions, the lessor may refuse the rental, subject only to reimbursement of the deposits paid.

B/ Choice of route

The customer can freely choose the route that suits him and the people he authorizes to use the equipment he has rented.
The route chosen by the customer is specified in the rental contract. The customer certifies that he and the people he authorizes to use the equipment he has rented have informed themselves of the regulations, difficulties and dangers of the route they have chosen to take.

2-4/ The customer's obligations relating to the completion of the descent

The rental partner of CANOE-FRANCE.COM informs the customer of the regulations and signs applicable to nautical courses, navigation classes, land exit routes from the course, hydrological and meteorological data, conditions for crossing structures established on the course water when there are such structures and emergency call numbers (Displays).

A/ General French regulations concerning navigation in Canoe Kayak

Generally in France, navigation on a watercourse is prohibited when:
– The air temperature is equal to or lower than 0°
– During stormy weather or in weather alert.
– When the river rises and reaches its alert level.
On certain rivers or well-specified geographical areas, specific regulations may exist (prefectural or local)
These levels can be consulted on the Vigie Crue website https://www.vigicrues.gouv.fr
Warning: Wearing closed shoes is obligatory (see prefectural decree).

B/ Loss/Abandonment/Behavior

Leaving any equipment on the course is prohibited. Any abandonment will be invoiced by the rental partner at the price of the equipment rented, plus the cost of repatriation services for the boat and people, search costs will be invoiced and must be paid without delay.

Loss of equipment: failure to return rented equipment, whatever the reason, will result in the customer being billed for the full value in new condition of this equipment at the public sale price, in addition to the rental cost, payment will be made without delay.

The customer undertakes not to deposit or leave waste on the routes and to place it in a bin.
The damage to any public or private property on plots bordering the river is prohibited, under penalty of incurring the client's contractual, civil or criminal liability.
The customer undertakes to be courteous and to respect local residents and other users of the watercourse.
Completion of the descent is carried out under the responsibility of the client who acknowledges having been informed of the particular conditions for carrying out this route.

3/ MODIFICATION

The reservation is valid for the reserved period, it may be modified by the customer:
Whatever the reason (change of route, shuttle schedule, number of people, date, boat, etc.) the modification requested must be sent to us by e-mail to the rental provider no later than 48 hours before the date mentioned on the rental contract and can only be effective within the limit of available places. The modification will be systematically confirmed by e-mail to the customer, only receipt of this e-mail will release them from their previous reservation. If this modification results in an additional price, the difference will have to be paid at the reception of the rental service provider before departure. If the modification results in a price reduction; the amount may be the subject of a credit valid on all of our services during the current season.

4/ CANCELLATION/ WITHDRAWAL

By the customer subject to the following conditions:

Customers, non-professional individuals, may withdraw and cancel the reserved service. In the event of cancellation of the reservation, the customer will have the possibility of using the payment paid to reserve for another date during the current season.

CANOE-FRANCE.COM reserves the right to reimburse the consumer for all sums paid, within 30 days at the latest following the reservation date.

Special cases giving rise to full and individual reimbursement:
· Cases of force majeure: death, hospitalization, serious illness (upon presentation of proof). Be careful for groups, only the people concerned will be reimbursed.

By the service provider:

If for safety reasons: flood, weather conditions, etc., the service provider is forced to cancel the service, it will inform the customer as soon as possible and will provide a full refund of the sums paid. In this case, he cannot be held responsible for the non-performance of the service and cannot be ordered to reimburse the consumer double the deposit paid.

5/ PRICES AND PAYMENT OF SERVICES

The prices appearing on the website www.canoe-france.com are inclusive of VAT in euros, taking into account the VAT applicable on the day of the order.

The price includes, for each route offered by CANOE-FRANCE.COM, the equipment necessary for navigation and the transport service (if necessary).
Accessories such as neoprene suits are invoiced in addition by the rental partner (unless the latter, in view of the weather conditions, spontaneously offers a free loan of this equipment) as well as other services that may be requested by the customer (catering, supervision by a qualified instructor…).

The customer undertakes to pay the balance of all services by credit card at the time of booking on the CANOE-FRANCE.COM website, via the secure Stripe platform.

6/ APPOINTMENT TIMES AND DELAYS

A meeting time is communicated for certain routes;
respecting this schedule is imperative. In the event of a significant delay, the rental partner may, where possible, offer another time or another date.
If no alternative solution can be offered, the rental will be canceled without the customer being able to claim reimbursement of the deposit paid to CANOE-FRANCE.COM. The customer reserving equipment on the CANOE-FRANCE.COM site certifies having read the general and special conditions of sale set out above and undertakes to inform the participants of his group of all the terms and conditions.

7/ PERSONAL DATA

In accordance with the law relating to data processing, files and freedoms of January 6, 1978, users have the right to access and rectify data concerning them.

8/ SETTLEMENT OF DISPUTES
